General Terms & Conditions of East End Antigua

Article 1 – Scope of Application
These Terms and Conditions govern accommodation contracts and any other related agreements between East End Antigua and the guest (including guests using rooms for daily teleworking). Matters not covered by these Terms will be governed by the applicable laws of Antigua and Barbuda and generally accepted customs.
Any internal regulations or operational guidelines presented by East End Antigua (hereinafter referred to as “Regulations”) form an integral part of these Terms and Conditions.
These Terms and Conditions apply to the property regardless of the duration of stay of the guest on property.

Article 2 – Guest Registration
Upon check-in, guests are required to provide the following information at the reception:

  • Name, age, gender, address, and contact phone number

  • Expected date and time of departure

  • Any other information required by the property or Government Authorities for safety, management or legal requirement purposes. 

By confirming a booking at East End Antigua, the guest acknowledges and agrees to abide by these Terms and Conditions. All guests must sign the registration form upon check-in; failure to do so may result in denied access to the premises.

Article 3 – Booking Policy
All reservations must be guaranteed with a valid credit card or via wire transfer. Guests must present a valid government-issued ID and the credit card used for the reservation upon check-in. Failure to do so may result in cancellation without refund. East End Antigua reserves the right and the guest agrees that East End will pre-authorise the card prior to arrival. Reservations are only allowed for guests aged 18 and above.

East End Antigua is not responsible for any loss, damage, or inconvenience arising from fraudulent bookings made through unauthorised third-party websites, agents, or individuals claiming to represent our property. Guests are strongly advised to make reservations only through our official website or verified booking partners. Any payments or agreements made outside of these authorized channels are at the guest’s own risk, and East End Antigua will not be held liable for any resulting financial loss or disruption to travel plans.

Article 4 – Cancellation and No-Show Policy
Cancellations and refunds depend on the rate selected at the time of booking through our partners’ websites and agencies or through direct booking with East End. Guests are responsible for verifying the conditions applicable to their booking. No shows will always be charged for the full amount of their reservation value. 

Article 5 – Payment Terms
Full payment for the stay is required either at the time of booking or within the timeframe specified by the cancellation policy selected on our booking partner’s website or through direct booking with East End.  It is the guest’s responsibility to review and comply with the payment and cancellation terms applicable to their reservation. Failure to make payment within the specified period may result in automatic cancellation of the booking.

Failure to complete payment within the stated period may result in automatic cancellation of the booking. 

East End Antigua accepts credit cards, debit cards, wire transfers and cash. Any additional charges incurred during the stay, including but not limited to room service, minibar use, or damages, must be settled at check-out. East End Antigua reserves the right and the guest agrees to charge any outstanding balance to the card on file.

Article 6 – Refusal of Accommodation Contract
The property may refuse a reservation, cancel a booking or interrupt stays of one or more guests in the following cases:

  • Violation of these Terms and Conditions

  • The guest is deemed likely to violate laws, disturb public order or morality during the stay

  • The guest is affiliated with criminal or antisocial groups

  • The guest exhibits harassment toward other guests

  • The guest has a specified infectious disease

  • The guest has used or uses violence, threats, intimidation, or makes unreasonable demands to staff

  • In case of natural disasters or structural malfunctions

  • The guest is intoxicated, behaves abnormally, or shows extreme personal hygiene neglect

  • The guest concealed the intent to use the premises for commercial purposes

  • The guest fails to comply with booking, payment, or cancellation terms

Article 7 – Right to Information on Refusal
If the property refuses to enter into an accommodation contract under the previous article, the guest may request a detailed explanation of the reasons.

Article 8 – Check-in and Check-out
Standard check-in is at 2:00 PM and check-out by 11:00 AM. Early check-in and late check-out are subject to availability and may incur additional charges. Personal belongings left in the room past check-out time may be removed. A pre-authorization will be taken on the card as a guarantee.

Article 9 – Guest Behavior
Guests must behave respectfully toward staff, other guests, and property. Any form of abuse, threats, violence, or illegal conduct will result in immediate expulsion without refund. Staff are authorized to stop alcohol service if the guest becomes disruptive.

Article 10 – Liability for Damages
Guests are responsible for any damage, loss, or destruction of East End Antigua property caused by their actions, negligence, or that of their visitors. This includes, but is not limited to, damage loss or destruction to rooms, furniture, decor, fixtures, and equipment. East End Antigua reserves the right and the guest accepts that East End Antigua will charge the guest's credit card for the cost of repairs, replacements, or additional cleaning required. A damage deposit is required at check-in and will be refunded in full within seven (7) business days of check-out, subject to an inspection confirming no damage or outstanding charges. Refunds will be processed via the same payment method used for the deposit

Article 11 – Disclaimer of Liability
East End Antigua is not responsible for theft, damage, or loss of personal items, nor for accidents, illness, or unforeseen events during the stay. East End Antigua is not liable for any injury, illness, or accidents that occur during the stay, including those related to the use of East End Antigua facilities, participation in East End Antigua-arranged activities, or any external factors such as including but not limited to weather conditions. Use of facilities and participation in activities are at the guest’s own risk. 

Management is not responsible for delays, cancellations, or changes to the stay due to force majeure events, including but not limited to natural disasters, public service interruptions, wars, pandemics, or travel restrictions imposed by authorities. Travel insurance is strongly recommended. In such cases, the cancellation policies in effect at the time of booking will apply.

For safety and operational reasons, certain areas of East End Antigua are designated as No Access Areas and are clearly marked with appropriate signage. Guests are required to respect these signs and must not enter restricted zones under any circumstances.

East End Antigua is located within a gated residential community that includes other privately owned properties. While we are fully committed to maintaining the highest standards within our own grounds, please note that we have no control over the condition, maintenance, or activity levels of adjacent or neighbouring properties within the community.

Some of these properties may be undergoing renovations or may not be maintained to the same standard as East End Antigua. We do not assume any responsibility for the appearance, upkeep, noise, or ongoing works related to other residences or lots in the vicinity.

East End Antigua shall not be held liable for any accidents, injuries, losses, or damages that occur as a result of unauthorized access to restricted areas or to any location outside the property’s boundaries. By staying at the property, guests acknowledge and accept full responsibility for any consequences arising from failure to comply with these restrictions.

Article 12 – Smoking Policy
Smoking is permitted only in outdoor areas (terraces, balconies, beach). Smoking in rooms or bathrooms is strictly prohibited. Violation will result in a penalty charge of USD 500.

Article 13 – Emergencies and Safety
Guests must follow safety instructions in case of emergency. In case of danger to life or health, the property reserves the right to contact an ambulance.

Article 14 – Use of Facilities
Guests must use all areas including but not limited to beach, spa, lounge, and dining responsibly. The property is not liable for accidents or damages due to improper use.

Article 15 – Taxes and Additional Charges
All stays are subject to:

  • ABST (sales tax) at 17%

  • Guest Levy of USD 5 per person per night

  • Service charge of 10%

These charges will be applied at check-in unless already included in the booking rate.

Article 16 – Minimum Age Requirement
Only guests aged 18 or older may make a reservation. Minors may stay only if accompanied by adults and only if approved by the management at the moment of the booking. 

Article 17 – Security Deposit
A refundable security deposit will be required at check-in or at time of booking, according to the booking conditions. This deposit covers potential damages, excessive cleaning, or any unpaid charges incurred during the stay. The deposit will be refunded at check-out following inspection of the room or and will follow the same refund rules outlined in Article 10 of these Terms and Conditions.

Article 18 – Accidental Damage Insurance
East End Antigua has insurance coverage for any accidental damage caused by guests to the property, furnishings, or amenities during their stay.

To ensure the protection of the property and the proper activation of this insurance, a flat fee will be charged to guests, included in the security deposit, to cover the cost of the policy.

By booking and staying at East End Antigua, the guest expressly accepts the terms of the insurance coverage and authorises the use of the relevant amount in case of need.

It is understood that the insurance does not cover damage caused by gross negligence or wilful misconduct, nor the loss of personal belongings, for which the guest remains fully responsible. In such cases, any damages exceeding the insured value may be charged separately.

Article 19 – Housekeeping and Room Maintenance
Housekeeping is available for stays in the property when booking hotel rooms. The property reserves the right to clean every day. Linen/towel change is every 3 nights. Guests may decline daily cleaning by informing the staff in due time.

Management also reserves the right to access the room at any time, including on days other than those scheduled for cleaning, for maintenance purposes, legally required inspections, or emergency situations.

Guests may decline daily cleaning by informing the staff in advance. However, they may not refuse access justified by technical, legal, or safety needs, nor the cleaning scheduled every six nights for hygiene and sanitation purposes.

When booking the entire villa for exclusive use, a daily basic housekeeping service is included. Housekeepers will be present at the property from 10:00 AM to 2:00 PM to perform general upkeep of selected outdoor areas and a light refresh of the guest rooms. This basic service does not include linen or towel changes. Any additional housekeeping services, including but not limited to full cleanings or linen and towel replacement, must be requested in advance and agreed upon with East End Antigua. These services will incur supplemental charges and must be settled before check-in. 

Article 20 – Housekeeping and  Personal Belongings in Room
In order to ensure that room cleaning is carried out thoroughly and in accordance with our hygiene and sanitation standards, East End Antigua staff may, when necessary, carefully move personal belongings that obstruct or hinder the cleaning process.

This will always be done:
– with full respect for the guest’s privacy,
– without opening or inspecting containers or personal items,
– using disposable gloves and hygienically appropriate tools.

Any items moved will be repositioned as carefully as possible to leave the room clean and orderly.
We kindly invite you, if desired, to store valuables in the safe provided in each room. East End Antigua does not assume responsibility for items left unattended outside the safe.

Article 21 – Guest Health Conditions
Guests are responsible for bringing necessary medications or aids. The property does not provide medical assistance and is not responsible for complications related to pre-existing conditions. It is the guest's responsibility to inquire in advance about the medical services available on the island of Antigua, especially in the case of pre-existing health conditions or specific medical needs. The property cannot be held responsible for any difficulties related to access to medical care or the failure to obtain insurance coverage.

Article 22 – Outdoor and indoor Maintenance
East End Antigua is committed to maintaining the garden, beach, and all outdoor areas of the property in perfect hygienic and aesthetic condition, both when the property is booked as a hotel and when it is reserved entirely as a private villa.

To this end, gardening and maintenance staff will be regularly present on the property to carry out the necessary landscaping, cleaning, and outdoor space management.

In the case of a full villa booking, guests may not refuse access to the gardener, as this service is essential for the proper upkeep of the property, its overall appearance, and the usability of the outdoor areas, including for safety and hygiene reasons.

The gardener will carry out their duties with respect for the guests' privacy and comfort, doing their best to avoid any disturbance during the stay.

To ensure the property remains in optimal condition and to safeguard the well-being of all guests, our authorized maintenance personnel must be granted access to the premises at any time, including when the entire villa is booked for private use. Refusal of access to our maintenance staff may result in liability for any worsening of the issue or damages incurred due to delayed intervention.

Article 23 – Use of the Beach
The beach is unsupervised. Use is at the guest’s own risk. The property declines all responsibility for accidents, injuries, or damages.

Article 24 – Internet
Guests use the Internet network provided by East End Antigua at their own risk. The service may be interrupted or suspended without notice due to system malfunctions or other technical or operational reasons.

The property is not responsible for any loss or damage resulting from interruptions, suspensions, or malfunctions of the Internet service, regardless of the cause.

Should a guest use the Internet network in a manner deemed inappropriate by management, or in a way that causes or may potentially cause harm to the property, other guests, or third parties, East End Antigua reserves the right to immediately terminate the guest’s access to the network and to seek compensation for any resulting damages.

Article 25 – Parking
Parking is available for guests but does not imply custody. The property is liable only for damages caused by intentional or negligent actions of its staff.

Article 26 – Force Majeure
The property is not liable for delays or failure to deliver services due to unforeseen or uncontrollable events (force majeure). Alternative solutions may be offered at the management’s discretion.

Article 27 – Guests with Disabilities
Please note that some areas of the property may not be accessible to individuals with reduced mobility or disabilities. Due to the architectural features and natural landscape of the premises, full accessibility cannot be guaranteed.

Guests are strongly encouraged to contact the property prior to booking in order to assess whether the facilities and accommodations are suitable for their specific needs.

East End Antigua shall not be held liable in any way if a guest with a disability or reduced mobility chooses to proceed with a booking without having first verified the accessibility features of the property and without receiving confirmation from management regarding the suitability of the premises to meet their requirements.

It is the guest’s responsibility to communicate any specific accessibility needs in advance, and we will do our best to provide accurate information and assistance within our available means.

Article 28 – Natural Environmental Conditions
The property is immersed in nature. Insects, tropical wildlife, seaweed, wind, or rough seas are part of the natural setting. These are not grounds for complaints or refunds.

Article 29 – Maximum Number of Guests
The number of guests must not exceed that stated in the booking. No unregistered persons may be accommodated without written approval.

Article 30 – Prohibition of Unauthorised Events
Any event, party, or reception must be pre-approved in writing. Otherwise, the property may terminate the stay without refund.

Article 31 – Repairs and Maintenance
For the comfort, safety, and proper upkeep of the property, guests are strictly prohibited from attempting to repair or modify any appliances, fixtures, equipment, or structural components of the premises. This includes, but is not limited to, plumbing, electrical systems, air conditioning units, kitchen appliances, lighting fixtures, and furniture.

Should any malfunction, damage, or issue be identified during the stay, guests are required to immediately notify management. Our dedicated maintenance team will promptly assess and address the situation. Under no circumstances may guests contact external technicians, service providers, or attempt to resolve the issue on their own.

Article 32 – Damage and Disorder
In case of significant damage or extraordinary disorder in the villa caused by guests, the property may retain the deposit or request further charges.

Article 33 – Video Surveillance
Some outdoor areas are monitored by CCTV for safety. No cameras are installed in private indoor areas.

Article 34 – Villa Check-out and Return
The villa must be left in a clean and presentable condition upon departure. A staff member will inspect the premises after check-out, and any damages or missing items will be documented and charged in accordance with the terms outlined in Article 10.

Article 35 – Residential Use Only
The villa may only be used for tourism or residential purposes. Commercial use without prior authorisation of management is prohibited.

Article 36 – Food Allergies and Dietary Restrictions
East End Antigua does not guarantee the absence of allergens (such as nuts, dairy, gluten, shellfish, etc.) in any food or beverage served on the property. Customized or allergy-specific menus are not provided, and all food is prepared in a kitchen where cross-contamination may occur.

Guests with known allergies or intolerances must inform the staff in advance of their stay and are responsible for clearly communicating any dietary restrictions or health concerns. While the team will do its best to assist where possible, it remains the sole responsibility of the guest to ensure that all necessary precautions are taken.

East End Antigua assumes no liability for any allergic reactions or health issues arising from the consumption of food or beverages on the premises when such reactions are caused by the customer’s failure to inform our staff of any allergies or dietary restrictions prior to ordering or consumption.

Article 37 - Guest Luggage and Belongings 

East End Antigua may store guest luggage before check-in or after check-out only by prior arrangement. Stored luggage will be returned to guests upon check-in if deposited beforehand, or at the time of check-out if held after departure.

In the event that luggage or personal belongings are forgotten or left unattended on the property after check-out, the following procedure will apply:
– In general, the property will wait to be contacted by the owner for instructions regarding the retrieval or shipment of the items.
– If the owner does not provide instructions within seven (7) days or cannot be identified, valuable items or those containing personal data will be handed over to the nearest police station.
– Perishable items or those that compromise hygiene (such as food, beverages, cigarettes, magazines, etc.) will be disposed of on the same day.

Management reserves the right to inspect the contents of unattended luggage or personal belongings, if necessary, solely for the purpose of handling them appropriately and safely, always with respect for privacy and in accordance with applicable regulations.

Article 38 - Hotel and Villa Rules and Regulations

We ask that guests abide by these Rules and Regulations to ensure that the hotel remains a public space and to ensure the safety and comfort of our guests. Guests who fail to abide by these rules may be refused further lodging or use of the hotel's facilities. Such guests may also be asked to pay for any damage caused to fixtures or equipment within the hotel.

 

Prohibited Actions:

  • Do not use guestrooms for purposes other than lodging without permission from East End Antigua.

  • Do not use open flames for heating or cooking in the guestrooms, corridors, or other common areas.

  • Do not smoke in non-smoking rooms (including smoking with e-cigarettes, heat-not-burn-tobacco, etc.). If smoking or cigarette butts are found in anon-smoking room, we will charge to the guest 500 USD room cleaning fee and room damage compensation in addition to the room charge. Do not smoke in bed or other areas prone to catching fire, even when staying in a smoking room.

  • Use the lobby to meet with outside visitors. Do not invite outside visitors into your guestroom.

  • Do not move equipment or fixtures within the hotel or guestrooms from their designated locations without reason.

  • Do not change or modify the current state of equipment within the hotel or guestrooms without permission.

  • Do not enter storage rooms, machinery rooms, emergency stairs (except during emergencies), or other staff-only areas.

  • Do not bring the following items into the hotel:
    a. Dogs, cats, birds, and other animals, or pets in general
    b. Items that emit a foul or strong odor
    c. Excessively heavy objects or an excessive amount of objects
    d. Guns, swords, or other weapons
    e. Explosives, volatile oils, or other items that are flammable or easily ignited
    f. Other items deemed a threat to the safety of other guests

  • Do not shout, sing, act in a way that causes powerful shaking or a commotion, or otherwise pose a nuisance or cause discomfort to other guests.

  • Do not engage in any gambling, immoral acts, or acts that disrupt public safety within the hotel or guestrooms.

  • Do not distribute advertisements or promotional materials, sell goods, or conduct business without permission.

  • Do not distribute leaflets, petition for signatures, engage in political or religious activities, hold meetings, display group or organizational power, or aid or abet such activities without permission.

  • Do not bring or park propaganda trucks, modified cars, or any other style of vehicle that the hotel deems may cause discomfort or inconvenience to other guests.

  • Do not leave personal belongings in the corridor or lobby.

  • Photography or filming that may pose a nuisance to other guests within the hotel or guestrooms is strictly prohibited.

  • Do not photograph or film the inside of the hotel for business purposes without permission from the hotel.

  • Assault, injury, threats, extortion, fraud, obstruction of business, unreasonable demands through intimidation, and any similar acts are prohibited.

  • Do not engage in any other acts deemed inappropriate by the hotel.

 

Article 39- Utility Interruptions and Alternative Supply Measures

Being located in the Caribbean, East End Antigua operates in an environment where occasional power outages, data interruptions, or water shortages may occur due to external factors beyond the property’s control.
While such events are rare, East End Antigua is fully committed to guest comfort and safety.
To minimize any inconvenience, the property is equipped with backup systems, including generators, rain-water collection and storage systems, and other alternative supply solutions, to ensure the continued provision of essential services whenever possible.
Guests acknowledge and accept that, while East End Antigua will make every reasonable effort to maintain utilities and respond promptly to any disruption, temporary interruptions may occur and are not grounds for cancellation or refund.

Article 40 – Legal Binding Nature of the Contract and Jurisdiction
This document is legally binding. By booking with East End Antigua, the guest confirms they have read, understood, and accepted the Terms and Conditions. These terms and conditions are governed by and construed in accordance with the laws of Antigua and Barbuda. Any legal action or proceeding related to the guest's stay at East End Antigua will be brought exclusively in the courts of Antigua and Barbuda, and guests consent to the jurisdiction of these courts

Article 41 - Dispute Resolution

In the event of a dispute between the guest and East End Antigua, both parties agree to first attempt to resolve the matter amicably through direct communication. If a resolution cannot be reached, the dispute may be submitted to the courts of Antigua and Barbuda under the laws of Antigua and Barbuda, and guests consent to the jurisdiction of these courts.
